General terms and conditions of sale

1. PLACING AN ORDER

1.1. In order to place an order, the customer must be at least 18 years of age. If you are a minor, please ask your parents or legal guardians to place the order on your behalf.

However, if you are between 14 and 18 years of age, you can request information about products and events. In any case, it is recommended that you have your parents or legal guardians involved before browsing and/or registering on our websites or mobile applications so that they can explain any questions you may have.

If you are under 14 years of age, please do not provide us with any personal information.

1.2. The Customer must fill in the personal data form found in our Online Shops (available 24 hours a day, every day), once he/she has accessed the page and clicked on the “finalise order” button.

1.3. When the Customer completes his/her order, we will send him/her an e-mail with the number and details of his/her order.

1.4. In the event that there is a problem with the delivery of the material, for example due to problems with the manufacture of the product, or the discontinuation of the product, we will contact the Customer as soon as possible to inform them of the situation and suggest alternative products that they may wish to purchase. Alternatively, we may offer to refund any monies paid to us for such products. The refund of these sums of money will be the limit of our liability towards the Customer, if it is impossible for us to supply the products ordered.

1.5. The Customer may cancel the order at any time and at no additional cost, provided that it has not been invoiced and sent by the transport company. If the package has left our premises, the customer may not refuse it to the transport company and must assume the purchase operation carried out.

1.6. Adding an item to the shopping basket does not guarantee that it will be reserved for the customer, as other customers may have purchased it while browsing the website. As soon as the payment process has been completed, the product is reserved for the customer.

1.7. We will make every effort to supply you with the products listed on your order confirmation. However, there may be occasions when it is impossible for us to supply such products due to, for example, such products not being in stock. In such cases we will contact you to inform you and may suggest alternative products that you may wish to purchase. If you do not accept our suggestions we will cancel your order in relation to the products we are unable to supply and refund any monies paid to us for such products. The refund of these sums of money will be the limit of our liability to you if it is impossible for us to supply you with the products ordered. Occasionally, the price of a particular product in our Online Shops may be erroneous and a higher or even lower price than the corresponding price may be shown due to a computer error. When this happens and if you have confirmed your order, we will contact you as soon as possible.

2. PAYMENT OF THE PRODUCTS

– Payment by bank transfer

The Customer must make the transfer to the account that will be indicated in due course. Upon completion of the order, the Customer will receive an automatic e-mail with the details of the bank account to which the payment must be made.

IMPORTANT: As the concept of the transfer, you must indicate the reference number that will be indicated at the end of the order.

IMPORTANT: For payments by bank transfer, the products will not be reserved until we receive the deposit in our account.

– Payment via PayPal:

Customers can pay quickly and securely with their PayPal account or with their credit or debit card, without sharing financial information with elsr-andaluz.com. PayPal automatically encrypts confidential data with the help of the best technologies available on the market.

 – Cash on delivery:

Payment will be made in cash at the time of delivery of the order at the delivery address indicated.

Note: In the case of orders of personalised articles commissioned by the client, the method of payment will be 50% by bank transfer or deposit when placing the order, accepting in this case the cash on delivery payment only of the remaining 50%. elsr-andaluz.com, will ask you for an identity document and proof of address that you must send us by e-mail which will be indicated to you in due course.

(With a cash limit of 2.499 € according to Law 7/2012 which limits cash payments)

3. DELIVERY AND RETURN POLICY

3.1. DELIVERY OF PRODUCTS

3.1.1. We will send the Customer their products to the delivery address given in their personal data form.

3.1.2. The shipping costs are 3€ for Spain.

3.1.3. We understand hours and days as working hours and days, thus excluding Saturdays and Sundays and public holidays. If for any reason attributable to elsr-andaluz.com this period is exceeded, we will inform the Client of the incident and alternative solutions will be proposed.

3.1.4. The Client undertakes to ensure that he or another designated person is at the address indicated to receive the package. If they are not there the first time, the carrier will insist several times. If it is still not possible to deliver the order, it will be returned to us, with the consequent refund to the Customer of the payment made, minus the delivery or return of the goods, which will be at the Customer’s expense.

3.1.5. If your order is special, the delivery time increases and may vary depending on the order, so it would be communicated more accurately to know in more detail your order.

3.2. PRODUCT WARRANTY

3.2.1. The products supplied by elsr-andaluz.com are guaranteed from the reception of the product against any manufacturing or assembly defect.

3.2.2. The products supplied by elsr-andaluz.com are mainly products for professional use destined for companies and professionals, so the guarantee is stipulated by the manufacturer in the guarantee document included in each product to which it applies, and the guarantee period may vary between 6 and 24 months.

3.2.3. All electrical products supplied by elsr-andaluz.com are checked before being sent, and it is confirmed that the device works correctly.

3.2.4. The guarantee of the products marketed by elsr-andaluz.com applies only and exclusively to the products themselves and therefore the shipping costs between the warehouse of elsr-andaluz.com and the address where the product is located, both there and back, are NOT INCLUDED. Thus, both during the warranty period and outside it.

3.3. RETURNS

3.3.1. If you are not satisfied with the product, you can request a return by sending an e-mail to direccion direccion@elsr-andaluz.com

3.3.2. The return period is 7 working days from the date of receipt of the shipment. The refund of the amount will be effective in the same payment method in which it has been made at the time we receive the goods, which will send us the customer assuming the shipping costs.

3.3.3. The product must be in perfect condition, in its original packaging and with any accessories or gifts included. The refund of the amount will not be effective until the goods arrive at our facilities and it is verified that the product has not been tampered with or altered in any way.

We will refund the payment received from you, with the exception of the additional costs resulting from the delivery transport, as well as the additional costs, special packaging, gift wrapping, etc.

3.3.4. If the return is because the product is defective or was not ordered, as well as defective products that are under warranty, the cost of collecting the goods will be borne by elsr-andaluz.com.

4. OBOBLIGATIONS OF ELSR-ANDALUZ AND THE CLIENT

4.1. elsr-andaluz.com undertakes to place at the disposal of the client all the necessary information relative to the products that it offers as well as the orders. elsr-andaluz.com is not responsible for the non-execution of the present conditions in the case of force majeure and in the case of the fault of the client or an unforeseeable event on the part of a person outside the contract.

4.2. The Client undertakes to fill in the order forms and their fields according to the instructions indicated. elsr-andaluz.com will protect the data in accordance with the law. The Client also undertakes to pay the price of the product, with the corresponding taxes and shipping costs.

4.3. We remind you that it is advisable to keep a copy of the data contained in the products purchased. elsr-andaluz.com is not responsible for any loss of data, files or, in general, any damage resulting from a failure by the Client to back up the data contained in the products purchased.

4.4. elsr-andaluz.com is not responsible for the consequences that may result from an inappropriate use of the products sold in its Online Shops.

5. PROTECTION OF PERSONAL DATA AND COMMENTS

5.1. The personal data that the Client must provide us with are indispensable for the sending of orders and the drawing up of invoices. Failure to provide this information will result in the automatic cancellation of orders. By registering on the page, the Client agrees to provide valid personal data, data that allow the provision of the service by elsr-andaluz.com and the correct identification of the registered Client, as well as sending information and advertising of the different products and offers that elsr-andaluz.com may have on its web pages.

5.2. All the opinions written by the Clients are controlled by the Marketing team. If the opinions received infringe the law, ethics or morals (abusive advertising, defamation, insults, comments out of context, etc.), elsr-andaluz.com reserves the right to reject or modify such opinions.

6. LIAISON WITH THIRD PARTIES

6.1. There is the possibility of sharing content or any type of information through social networks such as Twitter, Facebook or other applications, such activity being subject to the conditions of use and registration expressly established by these online platforms, without elsr-andaluz.com assuming any direct or indirect responsibility for the content published therein by users.

6.2. In these cases, you should be aware that by accessing these networks, you are leaving the web pages of the shops, to access an environment not controlled by elsr-andaluz.com. Consequently, elsr-andaluz.com will not assume any responsibility for possible breaches of the security of these environments.

6.3. elsr-andaluz.com declines all responsibility arising from the exchange of information between users through the web pages. Responsibility for the dissemination of data and statements disseminated on its web pages is in any case the responsibility of those who make them.

7. MODIFICATIONS TO LEGAL MENTIONS

7.1. elsr-andaluz.com reserves the right to modify the present Legal Notice without the prior express acceptance of the User being a prerequisite, with the modifications introduced being understood as tacitly accepted by the User in the event that he/she continues to access the Web pages from the date of publication of the aforementioned modifications. Otherwise, the User must immediately cease accessing and/or using the Websites.

7.2. This contract was originally drawn up in Spanish and the User accepts that the Spanish version of this document shall prevail over any version of the same in another language.

8. APPLICABLE LAW AND JURISDICTION

8.1. This Agreement shall be construed in accordance with and governed by the laws of Spain.

8.2. The parties agree, for the resolution of conflicts and waiving any other jurisdiction, to submit to the jurisdiction of the Courts and Tribunals of Valencia (SPAIN), unless the client is a private individual, in which case they shall be those of the client’s domicile.

Alternatively, as a member of Confianza Online and under the terms of its Code of Ethics, in the event of disputes relating to online contracting and advertising, data protection, protection of minors and accessibility, the Client may use Confianza Online’s out-of-court dispute resolution system (www.confianzaonline.es), at their choice.
